Specific Sale and Purchase Agreements (SPAs) are governed separately by the contract for each transaction.
3. Enquiries and Quotations
All information on this website is intended for general informational purposes and does not constitute an offer in a legal sense. An enquiry via the contact form or by email leads to a non-binding indication of availability and price. A binding agreement is only formed after written confirmation by TDK Petroleum and, where applicable, the signing of a formal SPA contract.
Quotations and indicative prices depend on confirmation from the refinery and market conditions. Validity is explicitly stated with each quotation.
4. Product Specifications
Product specifications (EN590, Jet A-1, etc.) on this website are indicative and based on standard refinery output. The final specifications of each shipment are confirmed via Q&Q certificates and, where agreed, SGS inspection reports. It is the buyer's responsibility to verify that specifications meet local laws and regulations at the destination.
5. Delivery Terms
We apply internationally recognized Incoterms (FOB, CIF, CFR) as most recently published by the International Chamber of Commerce (ICC). The exact terms are recorded per transaction in the SPA contract.
6. Payment
Payment terms are agreed per transaction and may include: irrevocable confirmed letters of credit, escrow arrangements through reputable institutions, or pre-payment. Specific terms are included in the SPA contract.
7. Compliance and Sanctions
All transactions are carried out in accordance with applicable international sanctions and export control regulations. The buyer is responsible for obtaining required import and compliance documentation at the destination. TDK Petroleum reserves the right to refuse transactions that conflict with these regulations.
8. Liability
Except in cases of wilful intent or gross negligence, TDK Petroleum's liability is limited to the amount invoiced under the specific transaction. We are not liable for indirect, consequential, or intangible damages.

These terms and any disputes arising from them are governed by the law of the United Arab Emirates. Disputes will preferably be resolved by mutual agreement. Where this is not possible, disputes will be submitted to the competent court in Dubai, unless a different competent court or arbitration body has been agreed in the SPA contract.
